Terms of Use

These Terms of Use ("Terms") govern your access to and use of the Vendo mobile application (the "App") provided by ITGROUP LV SIA ("we," "our," or "us"). By creating an account or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By posting a listing on Vendo, you fully agree to these Terms and confirm that the personal and contact information you provide will be stored and processed in accordance with applicable laws and our Privacy Policy.

2. User Account

• You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
• You must be at least 13 years old to use the App. If you are under 18, you represent you have your parent's or guardian's permission to use the App.
• You may register only one user profile. Creating multiple accounts to circumvent restrictions or rules is prohibited.

3. Content Rules & Prohibited Listings

Listings that do not comply with these rules may be edited, rejected, or deleted without notice. Repeated violations may lead to account suspension or termination.

Listings are not permitted and will be removed if they:

• Violate laws or ethics: Promote illegal activities, fraud, or violate generally accepted norms of behavior.
• Are placed in the wrong category: The listing must be placed in the most relevant category. If no perfect category exists, use the "Miscellaneous" or "Other" category.
• Contain inaccurate or misleading information: You must provide a precise, detailed description of the item or service.
  • Examples of violations: Offering a car for sale without disclosing it was in a major accident; selling furniture without mentioning that not all items in the photo are included; listing a property without specifying its condition or providing photos.
• Offer multiple items in one listing: Each listing must be for a single, specific item or service, with a detailed description and a precise price. Photos must depict only the item being sold.
  • Exception: Categories like "Manufacturing & Repair" may have different rules.
• Offer non-existent or unavailable items: The item must be physically present and available for sale/rent within your country (e.g., "Car is located in Germany" when listing in Latvia is not allowed).
• Contain contact information in text or images: All communication should go through Vendo's built-in messaging system. Phone numbers, email addresses, website URLs, social media handles, or QR codes are not allowed in listing descriptions or photos.
• Have a misleading price: The price must be final and include all additional costs (e.g., VAT for businesses). The price must correspond to the actual selling price without hidden conditions.
  • Examples of violations: Listing a phone for €10 when the real price is "negotiable"; advertising a travel package that doesn't include flight costs; renting an apartment for €30/night but requiring a 2-night minimum.
• Use prohibited images:
  • Low-quality images where the item's condition is not visible.
  • Images where the item is not the main focus.
  • Images that do not match the described item (e.g., stock photos, catalog images, pictures from the internet).
  • Images with excessive filters, text, watermarks, logos, or contact information.
  • Collages (multiple photos combined into one image).
• Use excessive capitalization or symbols: Using ALL CAPS in the title, excessive punctuation (!!!), or repeated characters to draw attention is not allowed.
• Contain marketing slogans in the title: Words like "SALE!", "BEST OFFER," "SUPER PRICE," "HOT," "NEW," "Attention," or store names/addresses are not permitted in the title. The title should be a factual description of the item.
• Infringe on intellectual property: Listings that violate copyright, trademark, or other proprietary rights.
• Are written in an unsupported language or contain excessive errors: Listings must be in English, Latvian, or Russian, and should be clearly written. Transliterating Russian text into Latin letters is not allowed.
• Require advance payment: Asking for full or partial prepayment for an item or service is prohibited due to the high risk of fraud.
• Are for licensed goods/services without proper information: Listings for items that require a license must include the seller's precise contact information and license number.
• Offer adult or erotic services: This includes job offers for video chats, erotic photo sessions, or any form of sexual services.
• Promote drugs, controlled substances, or related paraphernalia: This includes tobacco products, alcohol, precursors, controlled medications, and dangerous or harmful substances.
• Involve multi-level marketing (MLM), pyramid schemes, or "get rich quick" offers: This includes earning opportunities requiring registration, clicking links, or other dubious activities.
• Advertise other marketplaces, auctions, or services that compete with Vendo: This includes logos, ads, or links to other listing platforms.
• Offer occult services, non-traditional medicine, tattoos, or piercings.
• Solicit donations, deposits, or contributions of any kind.
• Contain links to malicious or irrelevant websites: Links that open pop-ups, play sound automatically, redirect to unrelated sites, or lead to low-quality, outdated, or overloaded pages are forbidden.
• Contain emotional or call-to-action text: The description should be informative, not contain slogans, declarations, or excessive use of exclamation marks.
• Are for cars with rolled-back odometers, hidden/license plates, or other fraudulent information.
• Are duplicate listings: Posting the same item multiple times is not allowed. Each listing must have a unique text.

4. Fees and Payment

• Listing an item is free for basic features. Premium services (e.g., featuring a listing) are available for a fee.
• All payments for premium services are processed securely through the Apple App Store or Google Play Store. You agree to their respective Terms of Service.
• All prices include applicable taxes (e.g., VAT).
• Listings are typically published within a short time after payment confirmation. Publication duration depends on the service selected.

5. User Responsibilities and Liabilities

• You are solely responsible for the content of your listings and for your interactions with other users.
• You assume full financial and legal responsibility for any losses or inconveniences caused to third parties or to us due to the content of your listings, including violations of laws, intellectual property rights, or these Terms.
• We act as a venue and are not a party to any transaction between users. We are not responsible for the quality, safety, or legality of items advertised.

6. Enforcement and Penalties

• We reserve the right to monitor, edit, reject, or remove any listing at our discretion for violating these Terms.
• If a listing is removed for violating these Terms, the fee paid for that listing will not be refunded.
• Repeated violations of these Terms may result in temporary or permanent suspension of your account.
• Attempting to circumvent a suspension by creating new accounts is strictly prohibited and will result in the permanent banning of all associated accounts.

7. Service Availability and Limitation of Liability

• We strive to keep the App available but do not guarantee uninterrupted, error-free service. Listing publication periods will be extended to compensate for any significant, proven downtime caused by us.
• To the fullest extent permitted by law, ITGROUP LV SIA shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of the App.

8. Changes to Terms

We may modify these Terms at any time. We will post the updated Terms within the App and update the "Last updated" date. Your continued use of the App after any change constitutes your acceptance of the new Terms.
